Clause 1. Application of Terms and Conditions of Sale
1.1 These terms and conditions of sale are applicable to all online ticket orders placed by the CUSTOMER on the FlyView Paris website https://www.flyview360.com/ via RocketRez. FlyView Paris reserves the right to adapt or change these terms and conditions at any time. The terms and conditions in force at the time of placing the order will be applicable.
Clause 2. Contractual Relationship
2.1. The information on the website and brochures for the current FlyView Paris year may be subject to change; the customer will be informed of such prior to the conclusion of the order.
2.2. FlyView Paris is the CUSTOMER’s only interlocutor and is liable thereto for the fulfillment of obligations arising from these terms and conditions of sale.
FlyView Paris may waive all or part of their liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.
2.3. The customer acknowledges that they have the capacity to contract under the conditions described in the following terms and conditions of sale: they are at least 18 years of age, legally capable of contracting and are not under any guardianship. Failing this, FlyView Paris reserves the right to cancel the order.
2.4. Pursuant to Article L.121-21-8 12 of the French Consumer Code, the services offered by FlyView Paris, as a leisure service to be provided on a given date or at a given frequency, are not subject to the right of withdrawal provided for in Articles L. 121-21 et seq. of said Code, with respect to distance selling.
2.5 The offers of sale on the https://www.flyview360.com/ website, governed by these terms and conditions of sale, are valid as long as they remain online, until the allocated places are reserved. They may therefore vary in real time.
Clause 3. Pricing and Payment
3.1. Prices listed on the website and in brochures for the current FlyView Paris season are inclusive of all taxes. They are determined according to the economic conditions on the date that tariffs are set and may be revised after the order, only in case of variation of taxes related to the services offered. In this case, FlyView Paris reserves the right to modify the amount of the order using the percentage change of the item concerned.
3.2. As soon as the ticket order (reservation) is validated and paid for, FlyView Paris cannot retroactively apply discounts or promotional offers.
3.3. All payments must be made in Euros by an authorized credit card on the day of booking. Full and immediate payment is required for all orders placed on the website. No other means of payment are accepted. FlyView Paris is not responsible for any charges to credit card transactions caused by exchange rate fluctuations or other reasons.
3.4. The date of ticket order validation corresponds to the date on which the order and its payment by credit card were made online (Law of March 13, 2000 on Electronic Signatures)
3.5. Any ticket order form signed by the customer by means of a “double-click” constitutes an irrevocable acceptance that cannot be challenged. The “double-click”, associated with the authentication and non-repudiation procedure and the protection of message integrity, constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
3.6. Payment by credit card is made on our partner’s—STRIPE—secure bank servers. This means that no banking information concerning the customer is sent via the FlyView Paris website or the RocketRez interface. Payment by credit card is therefore perfectly secure; the customer’s order will be recorded and validated as soon as the bank chosen by the customer accepts the payment.
3.7. The CUSTOMER’s credit card details are encrypted using the AES-256 (Advanced Encryption Standard) protocol and are never sent in plain text over the network. Payment is made directly to the bank. FlyView Paris and the RocketRez interface do not have, under any circumstances, access to these details and do not keep them on servers. This is why the customer is asked for them every time a new transaction is made on our website.
3.8 The CUSTOMER has the guarantee that their bank account will be debited only once by FlyView Paris via their secure payment site, for the total amount of the ticket order.
3.9. FlyView Paris reserves the right to refuse to honor a tick order from a customer who has not paid for a previous order in full or with whom a payment dispute is being handled.
Clause 4. Validity of online ticket orders
4.1. Dated online ticket orders purchased via the FlyView Paris website are only valid for the date and time chosen by the customer when placing the order. Once validated, the order cannot be changed in any way. It is therefore not possible to change the date or time chosen by the customer once the order has been confirmed.
4.2. FlyView Paris reserves the right to refuse access to visitors without refund or changing the reservation for any tardiness with respect to the time slot indicated on the ticket.
4.3. Visitors are requested to arrive 10 minutes before the departure time indicated on their ticket.
4.4. Visitors with online tickets may have their height checked. Anyone under 1.20m (4 feet) tall is not allowed on the FlyView Paris attraction. No refunds will be given to persons who have purchased a ticket who are under 1.20m (4 feet) tall.
4.5. FlyView Paris can in no way be held liable for any loss or theft of tickets ordered. Copies may not be issued on the spot.
4.6. All information appearing on the confirmation emails will be deemed accepted by the CUSTOMER if they have not disputed them by registered letter with acknowledgment of receipt within 8 days. However, they can only be contested if they differ from those provided in the reservations.
4.7. By keeping and/or printing the confirmation page or email sent by FlyView Paris, the CUSTOMER has proof of their order.
Clause 5. Cancellations
FlyView Paris will be unable to reimburse any services defined in the context of these T&Cs in the event of (i) non-use by the customer; (ii) reasons related to the weather or the exceptional cancellation of a show.
Clause 6. Presentation of Online Ticket Orders
6.1. Online tickets, called “vouchers”, received by email once the order has been processed, must be presented to the cashier on the day of your visit.
They can be presented either printed on white paper, or on a digital device that can be read by the barcode scanner.
6.2. Printed document: the functionality of printing ticket orders purchased online implies printing said documents on an ordinary printer from the internet. The customer must ensure that printed ticket orders are of acceptable print quality, and must comply with the validity conditions described below.
Partially printed, soiled, damaged or illegible documents will not be accepted and are considered void. If the print is poor quality, the customer must reprint their online ticket(s) so that the print quality is acceptable. The customer can check the print quality is acceptable by ensuring that all written information on the online ticket order, including the barcode, is clearly legible. FlyView Paris accepts no responsibility for errors or irregularities that may occur during the ordering, processing or printing of orders for online tickets printed by the customer.
Document presented on a digital device: The “voucher” can be presented to the cashier on a portable digital device (e.g. mobile phone or tablet). This means that the customer has downloaded said document prior to arriving on-site and ensured that their mobile device is in working order. The customer must present the document in such a way that the barcode can be scanned directly without any intervention by FlyView Paris staff. Partially downloaded, damaged or illegible documents will not be accepted and are considered void. FlyView Paris accepts no responsibility for errors or irregularities that may occur during the ordering, processing or downloading of orders for online tickets downloaded by the customer. Similarly, FlyView Paris cannot be held liable for any inconvenience or damage inherent to the use of the internet network, in particular for a breakdown in service, an external intrusion or the presence of computer viruses.
6.3. Each printed or downloaded online ticket order has a unique barcode, which is checked and registered at the entrance to FlyView Paris, using barcode readers, which allows access to FlyView Paris. Visitors cannot be admitted to FlyView Paris more than once with the same online ticket order. Only the first person to present the online ticket will be admitted; this person is presumed to be the legitimate bearer of the order. Online ticket orders are personal and non-transferable. They are non-exchangeable and non-refundable.
Clause 7. Intellectual Property
Trademarks, domain names, products, software, images, videos, texts or more generally all information subject to intellectual property rights are and remain the exclusive property of FlyView Paris. No assignment of intellectual property rights is made to the Purchaser through the General Terms and Conditions. Any total or partial reproduction, use or modification of these for any reason whatsoever is strictly prohibited.
Clause 8. Personal Data
8.1. In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and oppose their personal data. This right can be exercised by writing to us at the following address, indicating your full name and address: FlyView Paris – 30 rue du 4 septembre, 75002, Paris, France.
8.2. Personal data collected by FlyView Paris when purchasing a ticket online is strictly reserved for the use of the ticket office.
Clause 9. Evidence - Preservation - Archiving
The digitized registers, kept in the Vendor’s computer systems, under reasonable security conditions, are considered as proof of the contract of sale, of the date, and of the orders and payments between the parties. Orders and proof of payment are archived on a reliable and durable medium in such a way that they correspond to a true copy, in accordance with Article 1379 of the French Civil Code.
Clause 10. Applicable Law, Claims and Litigation
10.1. These terms and conditions of sale are subject to French law and are governed by the competent courts in Paris.
10.2. Any claim arising during the performance of the services defined herein must be made as soon as possible by the CUSTOMER, on the spot and in an appropriate manner, so that FlyView Paris can find a solution as soon as possible.
